CITIZEN POLICE ACADEMY
WAIVER OF LIABILITY, RELEASE, INDEMNIFICATION AND
HOLD HARMLESS AGREEMENT

I, the undersigned (Applicant), for and in the sole consideration of the privilege of participating in the Citizen Police Academy of the City of Kerrville (the “Citizen Police Academy”), and being allowed to use City of Kerrville property, equipment, and services, including but not limited to the firing range, self-defense instruction, and vehicles, recognize that such activities involve a risk of property damage and/or physical injury, including death.  I hereby agree to assume the risks attendant to all activities associated with participation in the Citizen Police Academy, including but not limited to:  damage to my property, personal injury, and/or death as a result of motor vehicle accidents or motor vehicle collisions; the acts of others associated with any and all Citizen Police Academy activities including firing range activities and self-defense instruction; the acts of third parties; and my own errors, omissions, or negligent acts.  I also hereby agree to assume the risk of property damage and/or personal injury to others resulting from my own errors, omissions or negligent acts associated with my participation in the Citizen Police Academy.

I, BINDING MY HEIRS, EXECUTORS, ADMINISTRATORS, AND ASSIGNS, HEREBY RELEASE, INDEMNIFY, DEFEND AND HOLD HARMLESS THE CITY OF KERRVILLE AND ALL ITS OFFICIALS, OFFICERS, AGENTS AND EMPLOYEES IN BOTH THEIR PUBLIC AND PRIVATE CAPACITIES, FROM ANY AND ALL LIABILITY; CLAIMS; SUITS; DEMANDS; EXPENSES OF LITIGATION, INCLUDING BUT NOT LIMITED TO COURT COSTS AND ATTORNEYS’ FEES; INJURY TO OR DEBT OF ANY PERSON OR LOSS OF, DAMAGE TO, OR LOSS OF USE OF ANY PROPERTY; OR CAUSES OF ACTION ARISING OUT OF, RELATED TO, OR CAUSED IN WHOLE OR IN PART BY MY ACTIONS, ERRORS, OMISSIONS, OR NEGLIGENCE , WHETHER OR NOT ALSO CAUSED IN PART BY A PERSON INDEMNIFIED HEREUNDER.  

It is further agreed that the execution of this "Waiver of Liability, Release, Indemnification and Hold Harmless Agreement" will not constitute a waiver by the City of Kerrville of the defense of governmental immunity where applicable, or any other defense recognized by the courts of the State of Texas.

RIDE-ALONG APPLICATION

The Kerrville Police Department is pleased that you have chosen to participate in our Ride-Along program. The purpose of the program is to provide interested citizens with insight into the day-to-day, frontline operations of the Department. It is our hope that you will find this experience both informative and enjoyable.

We would like you to be fully aware of the conditions and circumstances under which this program operates:

1.    You will be assigned to ride with a Police Officer of this Department. He/she will be assigned to his/her normal duties and will respond to all calls for service to which he/she is assigned.

2.    Police officers may be and often are assigned duties, which involve danger and serious risks. The officer with whom you will ride is no different.  He/she will not avoid or disregard duties that involve emergencies or dangers simply because you are with him/her.

3.    You are aware that the right front passenger airbag has been disconnected for safety reasons due to equipment mounted in the police units.

4.    While every effort will be made to ensure your safety, the police officer’s primary responsibility is to carry out his/her assigned duties.

5. The police officer you will accompany is happy to discuss his/her duties and responsibilities insofar as time permits. If, however, an emergency should arise, you must  IMMEDIATELY AND WITHOUT QUESTION comply with any orders or directions given to you by the officer. This is for your own safety.

RELEASE

IN CONSIDERATION OF PERMISSION, WHICH I HAVE RECEIVED TO ACCOMPANY ONE OR MORE POLICE OFFICERS OF THE KERRVILLE POLICE DEPARTMENT OF THE CITY OF KERRVILLE, TEXAS, A MUNICIPAL CORPORATION, IN THE COURSE OF THEIR DUTIES, I, THE UNDERSIGNED DO HEREBY RELEASE THE CITY OF KERRVILLE, ITS POLICE OFFICERS, OFFICIALS, AGENTS, SERVANTS AND EMPLOYEES FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS AND CAUSES OF ACTION THAT I MAY HEREAFTER HAVE ON ACCOUNT OF ANY AND ALL INJURIES AND DAMAGE TO ME OR TO MY PROPERTY, OR MY DEATH, ARISING OUT OF OR RELATED TO ANY HAPPENING OR OCCURRENCE WHILE I AM ACCOMPANYING ANY OFFICER OR OFFICERS OF THE KERRVILLE POLICE DEPARTMENT ON DUTY, OR INCIDENTAL THERETO, AND FOR THE SAME CONSIDERATION, I HEREBY RELEASE AND AGREE NOT TO SUE THE CITY OF KERRVILLE,  ITS POLICE OFFICERS, OFFICIALS, AGENTS, SERVANTS AND EMPLOYEES, AND AGREE TO FOREVER HOLD THEM HARMLESS FROM ANY SUCH LIABILITY, CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION.

I HAVE READ AND UNDERSTAND THE CONDITIONS OF THIS PROGRAM AS STATED ABOVE AND HEREBY VOLUNTARILY ASSUME ALL RISK OF LOSS, DAMAGE, OR INJURY TO ME OR MY PROPERTY, INCLUDING DEATH, WHICH MAY BE SUSTAINED WHILE OR INCIDENTAL TO ACCOMPANYING ONE OR MORE KERRVILLE POLICE DEPARTMENT POLICE OFFICERS WHILE ON DUTY.

THIS RELEASE AND AGREEMENT SHALL BE BINDING UPON ME AND MY HEIRS, EXECUTORS, ADMINISTRATORS, PERSONAL REPRESENTATIVES AND ASSIGNS, AND SHALL INURE TO THE BENEFIT OF THE SAID CITY, AGENTS, PUBLIC OFFICIALS AND PERSONS HEREIN DESIGNATED, AND THEIR HEIRS, EXECUTORS, ADMINISTRATORS, PERSONAL REPRESENTATIVES, ASSIGNS AND SUCCESSORS IN OFFICE.
